About these terms
These Terms of Service (the "Terms") govern your access to and use of The Consiliom (the "Service"), a personal planning and wellbeing application together with its optional organisation workspaces. By creating an account, or by accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
We may update these Terms from time to time. When changes are material we will version the update and bring it to your attention before it applies to you. Continuing to use the Service after an update takes effect means you accept the revised Terms.
The Service
The Consiliom helps you set a direction, define pillars, run missions and execute a weekly plan scored with points and streaks, alongside optional wellbeing and care-coordination tools. It is provided for personal organisation and general wellbeing only.
The Service is not a medical device and does not provide medical, legal, financial or other professional advice. It does not diagnose, treat or monitor any condition and is not an emergency or crisis service. If you or someone else may be at immediate risk, contact your local emergency or crisis service straight away.
Eligibility and your account
You must be at least 18 years old to use the Service. You agree to provide accurate account information and to keep it up to date, to keep your credentials confidential, to use multi-factor authentication where we require it, and to tell us promptly if you suspect any unauthorised use of your account. You are responsible for activity that occurs under your account.
Free and paid subscriptions
The Service is free to use. Core planning and tracking features are available at no charge. We also offer optional paid subscriptions that unlock additional or premium features. The features included in each plan, and their prices, are shown in the app at the point of purchase.
You are never required to buy a subscription to keep using the free features. You can start, change or stop a paid subscription at any time from your account settings.
Billing, payments and auto-renewal
Payments for paid subscriptions are processed securely by our payment provider, Stripe. We do not collect or store your full card details; they are handled entirely by Stripe and are subject to Stripe's own terms and privacy policy. By subscribing you also agree to any applicable Stripe terms presented at checkout.
Paid subscriptions are billed in advance on a recurring basis (for example monthly or annually, as selected) and renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. Prices are stated inclusive or exclusive of tax as indicated at checkout; you are responsible for any applicable taxes. We will give you reasonable notice of any price change before it takes effect, and you may cancel if you do not accept it.
Cancellation and refunds
You can cancel a paid subscription at any time from your account settings. Cancellation stops the next automatic renewal; you keep access to paid features until the end of the billing period you have already paid for, and the free features remain available afterwards.
Because subscriptions are billed for a period of access, payments already made are generally non-refundable except where required by law. If you are a consumer in the UK or EU you may have a statutory right to cancel within 14 days of purchase; where you ask us to begin providing a paid digital service immediately, you acknowledge that this right may be lost or reduced once provision has begun. Nothing in this section removes any refund or cancellation right you have under mandatory local consumer law.
Acceptable use
You agree to use the Service lawfully and to respect the security, privacy and rights of others.
- Do not attempt to access another person's account, or an organisation, without authorisation.
- Do not upload unlawful, harmful or malicious content, or infringe anyone's intellectual property or privacy rights.
- Do not probe, scan, disrupt or attempt to bypass the security, rate-limit or access controls of the Service.
- Do not rely on the Service for emergency monitoring, diagnosis, or automated decisions with legal or similarly significant effects.
- Do not share your account, invitation links, recovery codes or authentication secrets with anyone else.
Your content
You keep ownership of the information and content you add to the Service. You grant us the limited permission needed to host, process and display that content solely to operate and provide the Service to you. You are responsible for the content you provide and for ensuring you have the right to provide it.
Availability and changes to the Service
We work to keep the Service available and reliable, but it is provided on an ongoing basis and we may add, change, suspend or remove features for security, legal, operational or product reasons. We may perform maintenance that temporarily interrupts access. Where a change materially reduces a paid feature you rely on, we will act reasonably and, where appropriate, offer a pro-rated refund of any prepaid amount for the affected period.
Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, to protect users or the Service, or to comply with law. On closure we will delete or de-identify your personal data in line with our Privacy Policy, subject to any retention we are legally required or permitted to keep. You can start an account-closure or data request through the Privacy Centre.
Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law we exclude implied warranties and do not guarantee that the Service will be uninterrupted, error-free or fit for a particular purpose. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, for fraud, or for your statutory consumer rights.
Subject to the above, we are not liable for indirect, incidental or consequential loss, or for loss of data or profits arising from your use of the Service, and our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or GBP 100.
Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer you keep the protection of the mandatory laws of your country of residence and may be able to bring proceedings there.
